Court Costs and Other Related Charges (Penal Code section 4750)

Penal Code section 4750 provides that cities and counties shall be reimbursed for reasonable and necessary costs connected with state prisons or prisoners related to any crime committed at a state prison, whether by a prisoner, employee, or other person; and for any crime committed by a state inmate at a state hospital. A city or county may apply for reimbursement of these costs incurred at a state prison or state hospital in the manner prescribed by the State Controller's Office.

Deadline for Filing Claims

Claimants have six months after the close of the month in which the costs were incurred (PC section 4750(j)) to file a claim.  Claims filed after the six month deadline will not be reimbursed by the State Controller's Office.

Review and Payment of Claims

The State Controller's Office approves claims for payment within 60 days in the order of receipt, or otherwise provides a written statement to the claimant explaining why the payment cannot be made within the specified time.  An Electronic Funds Transfer payment is made to the city or county treasurer and a copy of the remittance advice is posted to the State Controller's Office website.  Each department within the city or county awaiting reimbursement should contact its treasurer for payment information.
