9810-9812 Notice of Excess Proceeds: Publishing Criteria
9810. MANNER AND PERIOD OF PUBLICATION
If the last known address of a party of interest cannot be obtained, the tax collector must publish a notice of the right to claim excess proceeds in a newspaper of general circulation in the county (Rev. & Tax. Code §4676(b)). The notice must be published no later than 90 days after the sale of such property. The publishing schedule shall be once a week for three successive weeks with at least five days intervening between respective publication dates. The period of notice commences on the first day of publication and terminates on the twenty-first day. (Gov. Code §6063).
9811. COST OF PUBLICATION
The cost of the publication shall be deducted from the excess proceeds and shall be distributed to the county general fund (Rev. & Tax. Code §4676). See M-8513 for other costs of giving notice.
9812. FORM AND CONTENT
The Notice of Right to Claim Excess Proceeds shall be published in the form of a public notice. Figure 9.8 contains the recommended content and format.
